Who is Mitch Vaughan?

I’m a Puerto Vallarta–based real estate agent helping people escape cold winters and find their perfect 2nd or 3rd home in the Bay of Banderas. When I’m not matching clients with great properties, you’ll find me golfing, hiking, or exploring the incredible nature that surrounds our coastline. Even after years here, it still hasn’t worn off: living in this paradise feels just as amazing as the day I arrived.
If you’ve looked into buying property along Mexico’s coast, you’ve probably heard the word fideicomiso. For many foreign buyers, it sounds complicated or restrictive — after all, it’s different from the direct deed ownership we’re used to in the U.S. or Canada.
But here’s the truth: the fideicomiso has been the standard for decades, and far from being a limitation, it actually offers several unique benefits that protect you, your property, and even your heirs.
What is a Fideicomiso?
A fideicomiso is a bank trust, established for you as the beneficiary. While the title is technically held by a Mexican bank, you retain all the same rights as if the property were in your name directly: you can buy, sell, rent, remodel, inherit, or will the property without restriction.
Think of the bank as the administrator; not the owner. Their role is to ensure everything is properly recorded, regulated, and compliant under federal law.
The Benefits Many Buyers Overlook
Inheritance Made Simple
The fideicomiso lets you designate beneficiaries directly in the trust, avoiding lengthy probate proceedings.Extra Legal Protection
Because the trust is registered with a regulated Mexican bank, you have a safeguard against fraud or title disputes.Flexibility for Resale
The trust is fully transferable. If you decide to sell, the new buyer can step into the same fideicomiso without any complications.Peace of Mind
The system has been in place for decades, and thousands of U.S. and Canadian owners enjoy secure ownership through fideicomisos today.
Should You Consider the Interior Instead?
It’s true; if you purchase inland, outside the restricted zone (50 km from the coast or 100 km from borders), you don’t need a fideicomiso at all. Some buyers prefer this route.
But for those who dream of ocean breezes, golf communities, and walkable beach towns, the fideicomiso is not a roadblock. It’s a tested, government-backed structure that makes foreign ownership possible — and safe — in Mexico’s most desirable locations.
✅ Bottom Line: The fideicomiso isn’t something to fear. In fact, once most buyers understand it, they see it as a benefit — not a drawback.
